Terms of Service

Effective date: October 25, 2026

Welcome to RedFlags Dating App: Unhinged (“Unhinged”, “we”, “our”, or “us”). These Terms of Service (the “Terms”) are a legal agreement between you and Modra Consultancy Ltd (trading as Redflags), a company registered in Kenya at Kiserian Isinya Road, Neema House, Kiserian, Kenya, which operates Unhinged, and govern your use of the Unhinged mobile application, website and related services (together, the “Service”).

By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you do not agree, do not use the Service.

1. Eligibility

To create an account and use the Service, you must:

• Be at least 18 years old (or the age of majority where you live, if higher)
• Be legally able to enter into a binding contract
• Not be prohibited from using the Service under the laws of your country
• Not have been convicted of, or be required to register as a sex offender for, any sexual or violent crime
• Not have had a previous account removed by us, unless we have given you permission to return

We may ask you to confirm your age or identity at any time and may suspend accounts that we reasonably believe belong to anyone under 18.

2. Your Account

• You are responsible for the information you provide and for keeping your login details confidential.
• You are responsible for all activity on your account. Tell us immediately at support@unhingedredflags.com if you think your account has been accessed without permission.
• You may have only one account. Accounts are personal and may not be sold, transferred or shared.
• You can delete your account at any time from Settings → Delete account in the App.

3. Community Rules

You agree not to:

• Harass, bully, stalk, threaten, intimidate or defame anyone
• Post or send hate speech, or content that discriminates based on race, ethnicity, religion, disability, gender, sexual orientation or any other protected characteristic
• Post or send sexually explicit content, nudity, or any content involving minors
• Impersonate anyone, misrepresent your identity, age or relationship status, or use photos that are not of you
• Request or offer money, gifts, airtime, mobile-money transfers, investments or loans from or to other members
• Use the Service for commercial purposes, advertising, promotion, sex work or escort services
• Use the Service to commit fraud, scams or any other illegal activity
• Share another person’s private information without their consent
• Use bots, scrapers or automated means to access the Service, or interfere with its security or operation
• Create a new account after we have removed one of yours

We have zero tolerance for objectionable content and abusive members. Messages that break these rules are blocked before they are sent, anyone can report or block a member from their profile or chat, and our team reviews reports within 24 hours, removes offending content and removes members who break these rules.

Our Community Guidelines (in the App and at unhinged-w5r9.onrender.com/guidelines) explain these rules in more detail and form part of these Terms.

4. Your Safety

We do not conduct criminal background checks or verify the identity of our members. We are not responsible for the conduct of any member, on or off the Service.

You are solely responsible for your interactions with other members. Please take reasonable precautions when communicating with or meeting anyone, including:

• Keeping conversations in the App until you trust someone
• Never sending money or sharing financial information
• Meeting for the first time in a public place and telling a friend or family member your plans
• Arranging your own transport to and from a date

If someone makes you feel unsafe, use Block and Report in the App. If you are in immediate danger, contact your local emergency services first.

We may review reports, message content connected to a report, and account activity to keep the community safe, and we may share information with law enforcement where required by law or where we believe it is necessary to prevent harm.

Automatic safety alerts and AI features (such as the AI Red-Flag Decoder and chat coach) are aids, not guarantees. They can miss things or be wrong, and you remain responsible for what you send and for your own decisions.

5. Your Content

You own the content you post, such as photos, your bio, red flags and messages (“Your Content”). You are responsible for Your Content and confirm that you have the right to share it and that it does not break these Terms or any law.

By posting Your Content, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and adapt it (for example, resizing photos) only as needed to operate, improve and promote the Service. This licence ends when you delete Your Content or your account, except where Your Content has been shared with other members or must be kept for legal or safety reasons.

We may remove any content that we believe breaks these Terms or puts anyone at risk, without notice.

6. Purchases and Subscriptions

• Some features require payment, such as Pro, Premium and Elite plans. Prices are shown in the App before you buy and may vary by country.
• In the Android app, purchases are processed by Google Play, and in the iPhone app by Apple’s App Store; each is subject to that store’s terms. In the web app, plan passes are sold by Redflags (Modra Consultancy Ltd), and paid through Paystack (M-Pesa, card, Apple Pay or bank transfer). We do not receive your full payment card details.
• Web passes are one-off payments for 3 days, 1 week, 1 month, 3 months or 6 months. They never renew automatically and nothing more is charged; the plan simply ends when the time is up. Buying another pass of the same plan adds its days on top.
• Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before renewal. You can cancel any time in your Google Play or App Store account settings. Deleting the App or your account does not cancel a subscription.
• Time-limited passes (for example, 3-day passes) do not renew. They end automatically when their time is up.
• Except where required by law or by the store’s refund policy, payments are non-refundable, including for partially used periods. Refund requests for Google Play purchases are handled by Google Play, and for App Store purchases by Apple (reportaproblem.apple.com).
• Web pass refunds: if you were charged but your plan didn’t switch on, or you were charged twice for the same pass, email support@unhingedredflags.com with the payment reference (it starts with “rf_”) within 14 days and we will switch the plan on or refund you in full to the way you paid, usually within 7 working days. Otherwise web passes are non-refundable once the plan has started.
• We may change prices or features. Price changes will not affect a billing period you have already paid for, and we will give notice where required by law.

7. Suspension and Termination

You can stop using the Service and delete your account at any time.

We may suspend or remove your account, and remove your content, at any time if we reasonably believe you have broken these Terms or the Community Guidelines, created a risk for other members or for us, or if required by law. If we remove your account for breaking these Terms, you will not receive a refund for any purchases.

8. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we make no promises that the Service will be uninterrupted, secure or error-free, or that you will find a match or a compatible partner. We do not guarantee the accuracy of information provided by other members.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or opportunities, arising from your use of the Service or your interactions with other members, on or off the Service.

To the maximum extent permitted by law, our total liability to you for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$100.

Nothing in these Terms limits liability that cannot be limited by law, including your rights as a consumer.

10. Indemnity

You agree to compensate us for any claims, losses or costs (including reasonable legal fees) arising from your breach of these Terms, Your Content, or your interactions with other members, to the extent permitted by law.

11. Governing Law and Disputes

These Terms are governed by the laws of Kenya. Before starting any formal proceedings, please contact us at support@unhingedredflags.com so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be handled by the courts of Kenya, unless the law of your country of residence gives you the right to bring proceedings in your local courts.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the App or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

13. Apple App Store

If you downloaded the App from Apple’s App Store, the following also applies:

• These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content.
• Your licence to use the App is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the App. Contact us for support.
• If the App fails to meet any applicable warranty, you may notify Apple, which may refund the purchase price of the App (if any). To the extent permitted by law, Apple has no other warranty obligation for the App.
• We, not Apple, are responsible for any claims relating to the App, including product liability, failure to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the App infringes someone else’s intellectual property.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
